With a new week, comes a new episode of Legal Defense!  John and Kirk discuss a recent Supreme Court case that reversed a conviction where the defense attorneys presented evidence that because their client was black, he was more like to re-offend,  and an ACLU lawsuit against the Milwaukee Police Department claiming that police are routinely violating the Fourth Amendment by stopping persons of color without cause akin to New York City’s “stop and frisk” policy that was found unconstitutional.

With a new administration, comes a new episode of Legal Defense!  John is solo today and discusses President Trump’s tough on crime agenda, his manipulation of FBI crime data, the role of police in a free society in the age of Trump, the roles of the three branches of government especially in relation to crime policy, the implications of the Muslim ban – legal and otherwise, the potential dismantling of federal “consent decrees” that seek to reform corrupt local police departments, and the proposed massive increase in ICE agents and an executive order to give them carte blanche to detain people.

With a new administration, comes a new episode of Legal Defense!  Kirk and John discuss the recent redistricting litigation that found Wisconsin’s republican drawn legislative district lines were unconstitutional, the evolution of political parties in the context of that litigation, President Trumps executive order banning travel from seven predominantly Muslim nations and the ensuing lawsuits seeking a restraining order, and reports that President Trump ordered Immigration and Custom Enforcement agents to ignore any federal court orders restraining their power to enforce the Muslim ban.

The Legal Defense Show – 12/17/16

It’s another episode of Legal Defense on 101.5 FM WHBL Sheboygan!

With Kirk out of town this week, John does the show solo. He jumps into a discussion of the electoral college – what it is, how it works, and why, despite the presidential election having taken place on November 8th, the college will not be voting until Monday, December 19th. Explaining its inception under Article 2 of the Constitution, John tackles why the founding fathers implemented a system of indirect election of presidents, and what burden this system places on the college’s members.

In a later segment, John switches gears and addresses the persistent debate over the interpretation of crime statistics around the country, and how local contextualization can muddy one’s perception of changes in the crime rate.
